By accessing the NavNet Communications Internet network system you consent to be bound by, and are becoming a party to the terms and conditions of this agreement. If you do not agree to all the terms of this agreement, return all literature and sealed software (opened software cannot be returned) you have received from NavNet Communications for a full refund within five business days. Access to the system implies consent, however at any time you may cancel any outstanding portion of your subscription a s outlined herein.

NavNet Communications ("NavNet") hereby grants to the licensee, ("you") a nonexclusive license to use the services of NavNet Communication's Internet network system ("system") for access to the Internet, World Wide Web, FTP, e-mail and other electronic services that may be added from time to time. Nothing in this grant prohibits NavNet Communications from modifying the system or the fee structure as it pertains to the services provided, specifically in the area of increased service levels and functionality, additional services, data storage and such. In cases where additional fees will be levied, all such services will be optional.

By NavNet: This agreement will be terminated automatically if you fail to comply with the limitations described herein. Upon termination your user password will be changed to block further access to the system. Usage fees will be prorated on a daily basis to calculate any refunds or payments owed. By Licensee: Upon written notification, (electronic or paper), you may terminate this agreement giving thirty days notice, at any time. Usage fees will be prorated on a daily basis to calculate any refunds or payments owed. However, software is not refundable.

NavNet may make available registered software (for a fee), freeware and shareware applications which it deems suitable for use to access the system. Both NavNet and the licensee will be governed by the all license restrictions imposed by the associated vendors and authors of any software. You may use other applications as you choose. However NavNet will only extend support to registered applications provided to you by NavNet. NavNet offers no warranty of suitability or compatibility for any application offered other than the said application has been deemed to have some merit for access to the system.

NavNet will provide front line telephone and electronic support to the end user during regular business hours provided you are a registered subscriber of the system with your account in good standing. After hours support is available via a phone answering system. System problems will be resolved after hours, local problems with your equipment will be dealt with on the next business day. Free support does not extend to hardware problems experienced with your equipment, configurations of software, operating systems or applications not provided in the original user bundle or to problems resolvable by following the documentation provided by NavNet or to situations outside the scope of NavNet's control.

Use of NavNet services to carry on illegal activities will result in immediate termination of this agreement, notwithstanding any other clause contained herein. All data referencing such activities will be maintained for investigation by any applicable law enforcement agency. Services are for your end use only. Reselling, redistribution or other use of the system for which you receive a fee may be grounds for termination of your license. Attempting to learn another persons user information or configuring your software to masquerade as another user, fictional or real, or any attempt to bypass or break into NavNet system security is cause for immediate termination, without notice.

While we will maintain confidentiality of data, publicly accessible files such as web pages, ftp data and broadcast e-mail are audited by NavNet. Failure to pass such an audit will result in the offending file being removed from public display until corrected, or at our discretion, removed entirely form the system. Repeated posting of offensive material is grounds for termination of your account.

NavNet strives to provide a general rated Internet service. Should you try to access a site we have blocked, you will not be successful. Failure to access such sites does not constitute failure to provide service. NavNet reserves the sole right to determine which sites should be blocked. Posting information in unrelated areas or sending information to a large number of news groups is looked down upon by the Internet community. A pattern of such abuse is cause for termination of your account.

NavNet Communications will under no circumstances, legal theory, tort, contract or otherwise be liable to you or any other person for any indirect, direct, special, incidental or consequential damages of any character including, without limitation, damages for loss of goodwill, work stoppage, computer failure or malfunction, or any and all other losses, commercial or personal damages or losses, failure to earn or save, or any other damages or losses in excess of the balance of the paid up subscription, even if the licensee or any other person, organization or entity has informed NavNet Communications of the potential of such loss or damage, or any claim by any third party. This limitation will not apply to liability for death or personal injury to the extent that applicable law prohibits such limitations. Failure for the licensee to comply with the licensing agreements of software authors, vendors and other principals will be issues solely between the licensee and the software agents, regardless of the method the licensee obtained the software.
